Privacy Policy

Welcome to the GoStork Platform, a web-based platform available at www.gostork.com (the “Platform”). The Platform and related services are owned by GoStork, Inc. (“GoStork,” “we,” or “our”), and we have developed this Privacy Policy (the “Policy”) to inform users (“user(s),” “you,” or “your”) about how we collect and use information, and users’ rights with respect to the collected information.

Please read this Policy carefully. If you do not agree to be bound by this Policy, then do not access or use the Platform. By accessing and/or using the Platform, you accept and agree to be bound by this Policy and consent to our collection, use, sharing, and retention of your information as set forth herein. This Policy is incorporated into the GoStork Terms and Conditions (“Terms and Conditions”).

YOU MUST BE AT LEAST EIGHTEEN (18) YEARS OLD TO ACCESS THE PLATFORM AND USE OUR SERVICES. If you are under eighteen (18) years old, you are not permitted to use this Platform for any reason.

A. What Personal Information is Collected.

“Personal Information” means any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. When you use our Platform, GoStork may collect certain Personal Information, including but not limited to, your first and last name, mailing address, e-mail address, gender and sexual orientation, information about your partner, and information about your social media and other platform accounts.

GoStork may also request, and you may also provide, certain Personal Information about your partner. By submitting this information, you warrant that you have permission to submit the Personal Information on behalf of your partner, and that your partner has reviewed this Policy and agrees to our collection, use, and retention of your partner’s Personal Information in accordance with this Policy.

“Non-Personal Information” does not identify you, but provides insights regarding your use of the Platform. For example, GoStork may collect your IP addresses, passwords, browser activity, pages viewed, forms submitted, location data, and user preferences. We may use automated information tools, such as cookies, to collect certain types of Non-Personal Information. You can set your browser to reject cookies, but that may limit your use of some convenience features on the Platform.

To the extent applicable with the Platform’s current functionality, you may choose to allow us to access your location by granting the Platform access to your location when prompted or through your device’s location services settings. You may change these settings on your device, but this will impact your use of and access to the Platform.

Personal Information and Non-Personal Information are collectively referenced as “Information.”

Biometric information. If you use our look-alike photo search, we analyze the facial geometry of a photo you upload so that we can show you donor or surrogate profiles who resemble it. Facial geometry is biometric information. Before the first such search we ask for your consent in the chat, and you may decline; if you decline, we do not perform the analysis. We use it only to return resembling profiles to you. We do not use it to identify you, we do not sell it, and we do not share it with providers or with other users. The analysis is performed for us by Amazon Web Services and is not added to our index of donor and surrogate faces, although the photo itself remains in your conversation until it is removed. You may ask us at privacy@gostork.com to delete the photo and any data derived from it at any time. If you do not use this feature, we do not collect biometric information about you.

B. How We Use Information.

We use Non-Personal Information collected through automated information collection tools to store your preferences, improve website navigation, make personalized features and other services available to you, to generate statistical information, monitor and analyze user traffic and usage patterns, monitor and prevent fraud, investigate complaints and potential violations of our policies, to improve the our content and the products, services, materials, and other content that we describe or make available through the Platform, and otherwise help administer and improve the Platform.

We may identify you from your Personal Information and, except as otherwise stated, we may use your Personal Information to provide our Platform and services to you, including but not limited to:

• customizing or tailoring your experience with GoStork;
• responding to your requests and providing user support;
• for research purposes, such as developing business intelligence that helps us to enhance, operate, protect, make informed decisions and report on the performances of our Platform;
• for advertising purposes, such as providing you with resources that we think you may be interested in and providing third-party information or advertisements we think you may find useful;
• notifying you about our products or services;
• preventing or investigating fraud;
• fulfilling our legal obligations;
• enforcing the Platform Terms & Conditions of Use, including monitoring the content and proper use of the Platform; and
• for other purposes allowed by law.

In addition, we may use third‐party e‐mail providers to deliver communications to you. This is an opt-in e-mail program. If you no longer want to receive these e-mail communications, you may opt-out of receiving e-mail communications through the “unsubscribe” link.

We may, from time to time, invite you to participate in online surveys. The information requested in these surveys may include, but is not limited to, your opinions, beliefs, insights, ideas, activities, experience, purchase history, and purchase intent regarding products, events, and Services. The information collected by these surveys is used to research market trends, company growth, community needs, etc. Your input will help us to improve customer experience and shape development of our products and Services.

Artificial intelligence and automated processing. Parts of the Platform are powered by artificial intelligence, including our concierge, which answers your questions, helps you describe what you are looking for, and suggests donor, surrogate, clinic, and provider profiles. To do this we send the content of your conversations, and the information from your profile that is relevant to your request, to third-party providers that process it for us and return a result. Those providers are named in Section C. If you use voice mode, the audio of your speech is also sent to providers that convert it to text and generate a spoken reply.

We do not use your conversations to train artificial intelligence models of our own, and we require the providers we use to process your content only in order to return a result to us.

Our artificial intelligence does not make decisions about you that have legal or similarly significant effects. It answers, suggests, and drafts; a person at GoStork or at a provider decides. You may ask to speak with a member of our team at any point in a conversation, and you may browse and compare profiles yourself without asking the concierge.

C. How We Share Information.

We do not sell or rent your Personal Information to third parties. We may share your Personal Information with the following parties:

• Corporate affiliates and associated entities for the purposes described in this Policy, which are required to treat the information in accordance with this Policy.
• Third-party service providers that help us administer and provide the Platform (for example, a web hosting company whose services we use to host our platform and analytics companies who help us track usage information to improve our platform). We have entered into contractual relationships with these service providers and require them to comply with all applicable information privacy laws and regulations and to use the Information only for the purposes for which it was disclosed. We require that any third-party service providers limit their use of your Information solely to providing services to us and that they maintain the confidentiality, security, and integrity of your Information and not make unauthorized use or disclosure of the Information.
• Authorized third parties, who are parties directly authorized by you to receive the applicable Information, such as agencies or clinics. The use of your Information by an authorized third party is subject to the third party’s privacy policy and additional contractual obligations.
• Third parties in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings), in which case we will require the recipient to use such information in accordance with this Policy.
• As we believe necessary: (i) under applicable law; (ii) to enforce applicable terms and conditions; (iii) to protect our rights, privacy, safety or property, and/or that of our affiliates, you, or others; (iv) to detect, prevent, or otherwise address fraud, security or technical issues; (v) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment and (vi) to respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities, which may include authorities outside your country of residence.
Pursuant to your express consent.

The service providers we use. As of the date of this Policy, the third parties that process Information for us are:

  • Hosting and infrastructure: Google Cloud Platform (application hosting and file storage), Supabase (database hosting), and Cloudflare (domain name service and protection against automated abuse).
  • Artificial intelligence: Google, for the Gemini models that power our concierge; OpenAI, which converts text into the numerical representations we use to search profiles and our knowledge base; and, if you use voice mode, Deepgram for converting speech to text together with the speech and avatar providers we have configured.
  • Communications: Twilio, for text messages and phone number verification, and Twilio SendGrid, for e-mail.
  • Payments: Stripe. We do not receive or store your full payment card number.
  • Video consultations: Daily.co. Where all participants have consented to recording, recordings are stored in Google Cloud Storage and transcribed using Google Speech-to-Text.
  • Documents and signatures: PandaDoc.
  • Calendar connections that you choose to make: Google Calendar, Microsoft Outlook and Office 365, and Apple iCloud.
  • Look-alike photo search, if you use it: Amazon Web Services. See Section A.

Each of these is permitted to use your Information only to provide its service to us, on the terms described above in this Section C. This list may change as we add or replace providers, and the list in this Policy is the current one.

D. How We Retain Information.

GoStork will retain Personal Information receive as described in this Policy for as long as you use our Platform or as necessary to fulfill the purpose(s) for which it was collected, to provide our services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

E. How We Protect Information.

GoStork takes reasonable steps online and offline to safeguard your Personal Information from unauthorized or illegal access, modification, or use, including Secure Sockets Layer (SSL) encrypted connections (HTTPS), secure multi-tiered firewalls, encryption, secure cloud-based environments, server authentication, and industry-standard firewalls. If you have any questions about security on our Platform, or if you become aware of any unauthorized use of an account, loss of your account credentials, or suspect a security breach, notify us immediately via e-mail at privacy@gostork.com. If our security system is breached, we will notify you of the breach to the extent required under applicable law.

It is common knowledge that transmission of information via the internet is not wholly secure, and we cannot guarantee the security of your Personal Information, or any other information, transmitted to or through our Platform. Any transmission of Personal Information, or other information, is at your own risk. By using our Platform, you acknowledge and accept these risks.

F. Links to Third-Party Websites.

The Platform may contain links to other sites that are not operated by us but may be incorporated in the Platform. If you click on a third-party link, you will be directed to that third party’s website. Such third party links do not constitute an endorsement by us of those other websites, their content or services, or the persons or entities associated with those websites. This Policy does not apply to third-party websites. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the privacy policies and terms of all third-party websites, other websites you may visit, or services that you may choose to use.

For example, if you choose to access, visit, and/or use any third-party social networking service(s) that may be integrated with our Platform, we may receive your Information about you and your computer, mobile, or other device that you have made available to those social networking services, including information about your contacts through those services. Some social networking services may allow you to push content from our Platform to your contacts or to pull information about your contacts so you can connect with them on or through our Platform. Some social networking services also may facilitate registration or enhance or personalize your experience on our Platform. Your decision to use a social networking service in connection with our Platform, to the extent such functionality is made available, is voluntary. However, you should make sure you are comfortable with the information your third-party social networking services may make available by reviewing privacy policies of those providers and/or modifying your privacy settings directly with those networking sites/services.

G. Children’s Privacy.

We do not sell products or services for purchase by anyone under the age of thirteen (13). In accordance with the Children’s Online Privacy Protection Act (“COPPA”), we will never knowingly request or solicit Personal Information from anyone under the age of thirteen (13) without verifiable parental consent. In the event that we receive actual knowledge that we have collected such Personal Information without the requisite and verifiable parental consent, we will delete that information from our database as quickly as is practical. We reserve the right to request proof of age so that we can verify that persons under the age of 18 are not using the Platform.

H. General Data Protection Regulation.

a. Rights to Your Information

If you are a user accessing our Platform from within the EEA and we have collected your Information (such user herein referred to as a “Data Subject”), you have additional rights and options with regard to accessing, reviewing, correcting, and updating your Information, as well as how we use and disclose your Information. You may change, edit, update, or delete the Personal Information that you provided when you set up your account through our Service(s) through your account settings. You may close your account at any time from within the Platform, under Settings and then Security. You do not need to contact us and you do not need to give a reason. You may also request the deletion of this Information by sending an e-mail to privacy@gostork.com

As a Data Subject, you have the right to request access to your Personal Information as it exists in our records by logging into the account you have created or e-mailing us at privacy@gostork.com. You also have the right to rectify, correct, or amend your Information if it is inaccurate or incomplete. You may also have the right to erasure of your Information. When you close your account it is deactivated immediately, and your Personal Information is erased thirty (30) days later. Until that date you may undo the closure using the link in the confirmation e-mail we send you, and your account is restored in full. On erasure we remove your name, contact details, date of birth, address, government identifiers, and the information you have given us about your fertility journey. Messages you have sent to providers through the Platform are redacted rather than deleted, so that the other party is not left holding an incomplete record of your correspondence. Certain records must be retained, including signed agreements and invoices that we are legally required to keep as described in Section D; in those cases we erase you from the record rather than the record itself, so that your identifying Information is permanently overwritten and cannot be recovered. It is your responsibility at all times to ensure that you are in compliance with all applicable rules, policies, and regulations at the institutional, administrative, and federal levels regarding retention of research data, including, but not limited to, United States regulations governing retention and disposal of records.

A Data Subject may have the right to object to the processing of his or her Information, for example, due to his or her particular situation, for direct marketing uses, or for scientific or historical research. In certain circumstances, Data Subjects may have the right to obtain a restriction on our processing of their Information, in which case such Information will, with the exception of storage, only be processed with the Data Subject’s consent or in circumstances such as our exercise or defense of legal claims or the protection of another person. Data Subjects may also have the right to request that we provide data portability for their Information via a copy of the data in a commonly-used format and/or transfer their Information directly to another data controller (where technically feasible). Exceptions to these rights may apply, for example, if the processing is necessary for a task carried out in the public interest. Finally, if a Data Subject has given his or her consent to our processing of his or her Information for certain purposes, he or she has the right to withdraw consent to such use at any time by contacting us at privacy@gostork.com or via the contact information below.

If you are not satisfied with how we manage your Information, you have the right to make a complaint to a data protection regulator. A list of National Data Protection Authorities can be found here.

b. Geographic Data Transfers.

In some instances we may need to transfer your Information outside the EEA. In all cases, we take steps to ensure that transfers of such Information are performed in accordance with applicable law and carefully managed to protect your privacy rights and interests. Transfers are limited to countries that are recognized as providing an adequate level of legal protection or where we can be satisfied that alternative arrangement are in place to protect your privacy rights. Therefore, where we transfer your Information outside our corporate affiliates or to third parties who help provide our products and services, we obtain contractual commitments to protect your Information under Data Protection Agreements and pursuant to Standard Contractual Clauses. Some of these assurances are well recognized certification schemes, such as the EU – US Data Privacy Framework for the protection of Information transferred from within the EU to the United States. Where we receive requests for information from law enforcement or regulators, we carefully validate these requests before disclosing any Information.

I. Your California Privacy Rights.

California Civil Code Section 1798.83 permits California residents to request and obtain a list of what Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. Under Section 1798.83, California residents are entitled to request and obtain such information, by e-mailing a request to privacy@gostork.com.

If you are a California resident, you also have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. These include the right to know what Personal Information we have collected about you and how we use it, the right to request a copy of that Information, the right to request that we correct it, and the right to request that we delete it. We do not sell or share your Personal Information as those terms are defined under that law. We will not discriminate against you for exercising any of these rights. You may exercise them by closing your account from within the Platform, as described in Section H, or by e-mailing privacy@gostork.com.

J. Changes in the Policy.

We reserve the right to modify and update this Policy at any time by posting an amended version of the statement on our Platform. Please refer to this Policy regularly. If at any time we decide to use Personal Information in a manner different from that stated at the time it was collected, we will notify you either on the panel home page of our Platform or via e-mail.

K. How to Contact Us.

Because protecting your privacy is important to us, you may always submit concerns regarding our Privacy Policy on the contact us page. We will attempt to respond to all reasonable concerns and inquiries expeditiously.
